TERMS AND CONDITIONS FOR DRIVEN PUBLISHERS ELITE (DPE)

(AKA TERMS OF PURCHASE OR TERMS OF SERVICE)

By purchasing and joining our Driven Publishers Elite program (hereinafter the “community” or “DPE”), described in detail on our product page or qualification page (hereinafter the “website”), you accept and agree to be bound by these Terms and Conditions (hereinafter “Terms and Conditions” or “Agreement”) including our Disclaimer and Privacy Policy posted on our website and incorporated herein by reference.

The term “you” refers to anyone who purchases the community, uses, visits, and/or views our website. Driven DS Solutions Limited (“company”, “we,” or “us”) reserves the right to amend or modify these Terms and Conditions at its sole discretion at any time without notice, and by using our community, you accept those amendments. It is your responsibility to periodically check the website for updates.

Continued use of the community and website after any changes to our Terms and Conditions constitutes your acceptance of those changes.

INTENDED AGE

All information and content in the community and on our website are intended for individuals over the age of 18. By purchasing the community, you represent and warrant to us that you are over the age of 18 and can enter into these legally binding Terms and Conditions.

PRIVACY POLICY & DATA CONTROLLER

We respect your privacy. Your acceptance of our Privacy Policy is expressly incorporated into these Terms and Conditions. For the purposes of GDPR and relevant data protection laws, the Data Controller is Driven DS Solutions Limited (Cyprus).

PRODUCT DESCRIPTION: DRIVEN PUBLISHERS ELITE (1-YEAR MEMBERSHIP)

The Driven Publishers Elite (DPE) program is a comprehensive, 1-year membership designed for self-publishers seeking to advance their business. By purchasing the 1-Year Membership, you are granted access to:

• Community: Access to our private DPE community channels.
• Live Coaching: Access to weekly virtual meetings with Peter, Gerald, Andrey, and other successful publishers within the community.
• Knowledge Base: Access to our extensive library containing insights from 10+ 6- and 7-figure publishers.
• Recordings: Access to 50+ hours of recorded discussions.
• Workshops: Access to special Online Live Workshops (e.g., Goal Setting, Amazon Ads, Niche & Positioning).
• Templates & Resources: Access to various templates, scripts, and SOPs.
• AI Tools: Access to the latest AI prompts for niche research, cover creation, and outlining.
• DPE AI Coach: Access to our proprietary AI Coach.

• Mastermind Ticket: One (1) Complimentary Ticket to our next in-person Mastermind event.
  • Usage Policy: This ticket covers the cost of entry to the event only. Travel, accommodation, and food are the sole responsibility of the member.
  • Validity: This ticket is valid only for the specific “next” scheduled Mastermind event following your purchase. If you are unable to attend this specific event for any reason, the ticket is forfeited. It cannot be rolled over to a future year, transferred to another person, or exchanged for cash or credit.
• PublishElite Software: Access to our software solution to offer bonus materials (PDFs, courses, audiobooks) within your books.
• Workations: The opportunity to join shared workations (travel/accommodation costs are the responsibility of the member).

Membership Term

The membership is valid for a fixed term of one (1) year (365 days) from the date of purchase. Access to all materials, software, and community channels is strictly contingent on an active membership.

NO REFUND POLICY

All sales are final. Because DPE provides immediate access to proprietary digital information, software, community resources, and intellectual property, we maintain a strict No Refund policy.

By completing your purchase, you acknowledge and agree that:

• You are receiving immediate value in the form of digital access.
• You waive any right to a “cooling-off” period commonly associated with physical goods.
• No refunds will be granted for any reason, including but not limited to: lack of usage, changes in personal financial circumstances, or dissatisfaction with specific content.

ONLINE PAYMENTS (VIA WHOP)

All payments for Driven Publishers Elite are processed through our authorized payment processor and merchant of record, Whop. By making a purchase, you are entering into a payment agreement directly via the Whop platform. Your transaction is subject to Whop’s Terms of Service in addition to this Agreement.

• The name “Whop” or a variation thereof will appear on your bank or credit card statement.
• Whop handles the secure processing of your credit card, debit card, or other payment methods.
• For any questions regarding the technical aspects of billing, accessing your invoices, or managing your payment methods, please refer to your Whop User Dashboard.

MEMBERSHIP DURATION AND EXPIRATION

• One-Time Payment: Your purchase constitutes a one-time payment for a fixed access period of 12 months.
• Expiration: At the end of the 12-month term, your access to the community, course materials, coaching, and the PublishElite software will automatically expire.
• Manual Renewal: This membership does not automatically renew. To continue accessing the community and software after your first year, you must manually purchase a renewal or extension plan at the then-current rate.

MEMBERSHIP ACCESS & ONBOARDING (ANTI-PIRACY CONTRACT)

• Condition of Access: Access to the community, course materials, and software is strictly conditional upon the signature of our separate Anti-Piracy Agreement.
• Process: After completing your payment via Whop, you will be required to sign this document (e.g., via digital signature).
• Failure to Sign: You acknowledge that failure or refusal to sign the Anti-Piracy Agreement will prevent you from accessing the content. In accordance with our No Refund Policy, your purchase remains non-refundable even if access is withheld due to a failure to sign this agreement.

RECORDING OF GROUP CALLS

By participating in group calls, workshops, or virtual meetings within the Driven Publishers Elite community, you consent to the recording of these sessions.

• Internal Use: Recordings are posted within the community knowledge base for other members to view.
• External/Promotional Use: We reserve the right to use excerpts of these recordings for promotional, educational, or informational purposes publicly.
• Opt-Out: If you do not wish to be recorded or included in public-facing content, you must turn off your camera and microphone or refrain from participating in live sessions.

DATA HANDLING AND SECURITY

Our services, including communications and course hosting, are facilitated by third-party platforms including GoHighLevel and Whop. Driven DS Solutions Limited reserves the right to suspend access if we detect that you are using our platforms to store illegal data, malicious software, or content that infringes on third-party rights.

USER RESPONSIBILITIES AND CONDUCT

By joining the community, you agree to:

• Respect: Engage constructively. Harassment, hate speech, or disruptive behavior is strictly prohibited.
• Lawful Use: You must use the strategies and software provided for lawful purposes only.
• Account Security: You are responsible for your account. Sharing your login credentials with non-members is a strict violation of these terms.

Prohibited Activities

• Sharing, reselling, or distributing our proprietary course materials.
• “Scraping” or mass-downloading community data.
• Using the platform to spam other members.

Violation of these guidelines may result in the immediate termination of your membership without refund.

INTELLECTUAL PROPERTY

All content provided within DPE is the intellectual property of Driven DS Solutions Limited or its licensors. You are granted a limited, non-transferable, revocable license to access and use this content for your personal self-publishing business only. You may not reproduce, redistribute, or sell any materials found within the community.

AFFILIATE LINKS DISCLOSURE

We may recommend third-party tools or services. Some of these recommendations may contain affiliate links, meaning we earn a commission at no extra cost to you. We only recommend tools we trust, but you should always perform your own due diligence.

DISCLAIMERS

• No Income Guarantee: The information provided in DPE is for educational purposes. We make no guarantees regarding specific financial results, book sales, or income. Your results depend on your individual effort, market conditions, and implementation.
• No Professional Advice: We are not financial advisors, accountants, or attorneys.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Driven DS Solutions Limited shall not be liable for any indirect, incidental, or consequential damages (including lost profits) arising out of your use of the community, software, or coaching. Our total liability shall not exceed the amount you paid for the membership in the 12 months preceding the claim.

DISPUTE RESOLUTION AND GOVERNING LAW

These Terms are governed by the laws of the Republic of Cyprus.

• Informal Resolution: You agree to contact us at peter@drivenpublishers.com regarding any disputes before taking formal legal action or initiating a chargeback.
• Arbitration/Jurisdiction: Any unresolved disputes shall be settled by binding arbitration or in the competent courts of Nicosia, Cyprus.

TERMINATION

We reserve the right to terminate your access at our sole discretion, without notice, if you violate these Terms.

MISCELLANEOUS

• Entire Agreement: These Terms constitute the entire agreement between you and Driven DS Solutions Limited regarding DPE and supersede prior agreements.
• Severability: If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
• No Waiver: A failure or delay to enforce any provision is not a waiver of that provision.
• Force Majeure: We will not be liable for delays or failures caused by events beyond our reasonable control, including acts of God, labor disputes, internet or hosting outages, cyber incidents, government actions, or other force majeure events.
